Depuis 2003 une directive, modifiée en 2005, recommande à la police de procéder à la rédaction d’un procès verbal simplifié (PVS) lors de la constatation de la détention par une personne majeure d’une quantité de cannabis ne dépassant pas 3 grammes ou d’une plante de cannabis, destinés à l’usage personnel, sans circonstance aggravante ni trouble à l’ordre public.
Mais, à Anvers une association est poursuivie par ce qu’elle met à la disposition de ses membres un local pour cultiver à titre individuel une plante de cannabis. A l’occasion de divers festivals la police a déployé tout l’arsenal répressif à l’encontre des consommateurs de drogues en ce compris la détention d’une faible quantité de cannabis.
Certes il y a une volonté politique de ne plus criminaliser l’usager de cannabis. Malheureusement cette volonté n’est pas inscrite dans la loi. Le cannabis figure toujours sur la liste des produits prohibés au même titre que l’XTC, l’Héroïne, la cocaïne, etc. Il n’y a donc point de tolérance uniforme quant à la détention de cannabis en Belgique, même d’une faible quantité en vue d’un usage personnel.
La liaison Antiprohibitionniste n’a jamais cessé de rappeler qu’il est impératif de modifier la loi sur les stupéfiants si l’on veut envisager une politique juste et responsable en matière de drogues. Sans cela nous ne verrons jamais la volonté de ne plus criminaliser le simple usager de drogues se traduire en véritable réalité.
